Layby Terms of Use
Entering into a Layby with Wish-Art constitutes
your acceptance and agreement with the Terms of Use. Failure to adhere to the terms of use will result in forfeiture of any and all monies paid and orders related to the forfeited layby.
1. Layby Periods are available as following:
<$400 is only eligible for 30 days
>$400 is eligible for either 30, 60 or 90 days - in special circumstances 120 day layby may be available.
When filling out the form to request a layby please take note of the time periods - orders under $400 are not eligible for more than 30 days - if the incorrect period is selected the layby will be cancelled and you wil be notified within 24 hour to re-submit your order.

2. Layby's will be processed manually using the
form on the Layby Application page. Once your order is received, shipping will be added and divided and you will receive an invoice for the first instalment. This invoice must be paid within 48 hours or the order will be cancelled.

3. Invoices will be sent approximately one week
before the due date of each payment. Payment must be made on or before the dates agreed to at the beginning of the Layby Term.

4. Cancellation of Layby by you will result in the
following penalties:
~ Cancellation prior to payment of first invoice without penalty
~ Cancellation on second or subsequent payments will result in penalty payment of 20% penalty fee.

5. Failure to make payment on due dates will result in forfeiture of any and all monies paid during the course of the Layby as well as any products associated with the layby. A grace period of 1 week is offered for unpaid invoices - you will recieve only one grace period during your layby. Subsequent tardy payments will result in forfeiture of any and all monies.

6. You may pay a layby out earlier that previously
agreed by sending the outstanding balance to our paypal address with your order number to:

Please ensure you include your full name and e-mail address as used at the beginning of the layby.

7. Making an early, duplicate or extra payment
does not alter the due date of any outstanding balance
example #1 extra payment:
3 part payment for $550 = $183.34 each payment
Payment 1: Due 1st August $183.34
Payment 2: Due 1st September $183.34
Payment 3: Due 1st October $183.34
You wish to pay an extra $50 at the end of August, you remaining two payments are recaculated to $133.34 and $183.34 - payment due dates remain the same.
example #2 double payment:
4 part payment for $550 = $137.50 each payment
Payment 1: Due 1st August $137.50
Payment 2: Due 1st September $137.50
Payment 3: Due 1st October $137.50
Payment 4: Due 1st November $137.50
You wish to pay $275.00 for payment #2, your balance is now $137.50 - all though you have already paid for payment #3 you will still receive an invoice for that month for the outstanding balance - the due date for the balance then becomes the 1st of October.
8. Full refunds for cancelled Layby's may be made
under circumstance at the discretion of Wish-Art and its staff.
